The Swiss Federal Council has decided that the Federal Act on Data Protection (FDPA) will now definitely come into force on September 1, 2023. With this decision, the total revision is complete and both companies and individuals now have one year to implement it.
The new Data Protection Act will ensure better protection of personal data in the future. In particular, data protection will be adapted to technological developments, self-determination over personal data will be strengthened and transparency in the procurement of personal data will be increased.
By bringing the new data protection law and ordinances into force on September 1, 2023, the Federal Council is responding to a request from the business community. The implementation period of one year gives data protection officers sufficient time to take the necessary precautions to implement the new data protection law.
What does this mean for me?
The new data protection law in Switzerland will significantly increase the protection of personal data, comparable to the GDPR in the EU – a step that we of course very much welcome. For companies or private website operators, it is time to review the current web analytics tool to ensure that no personal data of visitors is transferred from Switzerland to the USA, as is the case with Google Analytics, for example.
The best solution: a web analytics tool that does not collect personal data by default and follows the privacy-by-design approach.
